These Terms of Use (“Terms”) are a binding agreement between you and Even Rütimann (“PenSnap”, “we”, “us”) governing your use of the PenSnap mobile application (the “App”). By downloading or using the App, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App.
1. The service
PenSnap identifies fountain pens from photos using AI and provides non-binding, estimated market values, plus a personal collection, wishlist and price alerts. Identifications and valuations are generated automatically and may be inaccurate or incomplete.
2. Eligibility & account
PenSnap is rated suitable for all ages, but to create an account, purchase a subscription, or have your data processed, you must be at least 13 years old. If you are under 18 (or the age of majority where you live), you may use PenSnap only with the involvement, consent and supervision of a parent or legal guardian, who agrees to these Terms on your behalf and is responsible for your use and any purchases. You must also meet the minimum age required to consent to the processing of personal data in your country.
You may use the App anonymously with limited functionality or sign in with Apple. You are responsible for activity under your account.
3. Subscriptions, billing & free trial
- PenSnap offers a free tier with a limited number of scans and an optional auto-renewable subscription (“PenSnap Premium”) that unlocks unlimited scans and additional features.
- Payment is charged to your Apple ID account upon confirmation of purchase.
- The subscription renews automatically for the same period and price unless you cancel at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours prior to the end of the period.
- Manage or cancel anytime in your device’s App Store account settings. Cancellation takes effect at the end of the current paid period.
- If a free trial is offered, any unused portion is forfeited when you purchase a subscription, where applicable.
- Prices are shown in the App and may vary by region; purchases, refunds and billing are handled by Apple under Apple’s terms.
4. Acceptable use
You agree not to: misuse or overload the service; attempt to bypass scan limits, security or attestation; reverse engineer, scrape or access the service by automated means; upload unlawful content; or use the App to infringe others’ rights.
5. Valuations are not advice
All values shown are non-binding estimates generated from data and AI. They are not a professional appraisal and must not be relied on for insurance, tax, buying/selling or legal decisions. PenSnap does not provide investment or financial advice. You are solely responsible for decisions you make.
6. Intellectual property
The App, its content and branding are owned by us or our licensors and are protected by law. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the App for personal, non-commercial purposes. Your own scans, photos and collection data remain yours.
7. Disclaimers
The App is provided “as is” and “as available” without warranties of any kind, to the maximum extent permitted by law, including any warranty that identifications or valuations are accurate, or that the service will be uninterrupted or error-free.
8. Limitation of liability
To the maximum extent permitted by law, PenSnap is not liable for any indirect, incidental or consequential damages, or for financial or other decisions made based on identifications or valuations shown. Where liability cannot be excluded, it is limited to the amount you paid for the App in the 12 months before the claim.
9. Termination
You may stop using the App and delete your account at any time (Profile → Delete account). We may suspend or terminate access if you breach these Terms or to protect the service.
10. Governing law
These Terms are governed by the laws of Switzerland, without regard to conflict-of-laws rules, and the courts of the Canton of Aargau, Switzerland have exclusive jurisdiction, unless mandatory consumer-protection law in your country of residence provides otherwise.
11. Apple App Store
These Terms are between you and us, not Apple. Apple is not responsible for the App or its content. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them. Maintenance, support and any product claims are our responsibility, not Apple’s, except as required by Apple’s standard Licensed Application End User License Agreement, which also applies and prevails in case of conflict on Apple-specific points.
12. Changes
We may update these Terms. Material changes will be indicated by updating the “Last updated” date and, where appropriate, an in-app notice. Continued use after changes means you accept them.

Diese Nutzungsbedingungen („Bedingungen“) sind eine verbindliche Vereinbarung zwischen dir und Even Rütimann („PenSnap“, „wir“, „uns“) über deine Nutzung der mobilen App PenSnap (die „App“). Mit dem Herunterladen oder Nutzen der App stimmst du diesen Bedingungen und unserer Datenschutzerklärung zu. Wenn du nicht einverstanden bist, nutze die App nicht.
1. Der Dienst
PenSnap identifiziert Füllfederhalter anhand von Fotos mittels KI und liefert unverbindliche, geschätzte Marktwerte sowie eine persönliche Sammlung, Wunschliste und Preis-Benachrichtigungen. Identifikationen und Bewertungen werden automatisch erzeugt und können ungenau oder unvollständig sein.
2. Voraussetzungen & Konto
PenSnap ist für alle Altersgruppen freigegeben, aber um ein Konto zu erstellen, ein Abo zu kaufen oder deine Daten bearbeiten zu lassen, musst du mindestens 13 Jahre alt sein. Wenn du unter 18 bist (oder unter dem Volljährigkeitsalter an deinem Wohnort), darfst du PenSnap nur unter Einbezug, mit Zustimmung und unter Aufsicht eines Elternteils oder gesetzlichen Vertreters nutzen, der diese Bedingungen in deinem Namen akzeptiert und für deine Nutzung sowie allfällige Käufe verantwortlich ist. Du musst zudem das Mindestalter erfüllen, das in deinem Land für die Einwilligung in die Bearbeitung von Personendaten erforderlich ist.
Du kannst die App anonym mit eingeschränktem Funktionsumfang nutzen oder dich mit Apple anmelden. Du bist für die Aktivitäten unter deinem Konto verantwortlich.
3. Abonnements, Abrechnung & Gratis-Testphase
- PenSnap bietet eine Gratis-Stufe mit einer begrenzten Anzahl Scans und ein optionales automatisch verlängerndes Abo („PenSnap Premium“), das unbegrenzte Scans und zusätzliche Funktionen freischaltet.
- Die Zahlung wird bei Kaufbestätigung deinem Apple-ID-Konto belastet.
- Das Abo verlängert sich automatisch um denselben Zeitraum zum selben Preis, sofern du nicht mindestens 24 Stunden vor Ende des laufenden Zeitraums kündigst. Die Verlängerung wird innerhalb von 24 Stunden vor Ende des Zeitraums belastet.
- Verwalten oder kündigen kannst du jederzeit in den App-Store-Kontoeinstellungen deines Geräts. Die Kündigung wird zum Ende des laufenden bezahlten Zeitraums wirksam.
- Wird eine Gratis-Testphase angeboten, verfällt ein nicht genutzter Teil beim Kauf eines Abos, soweit anwendbar.
- Preise werden in der App angezeigt und können je nach Region variieren; Käufe, Rückerstattungen und Abrechnung wickelt Apple zu Apples Bedingungen ab.
4. Zulässige Nutzung
Du verpflichtest dich, Folgendes zu unterlassen: den Dienst missbrauchen oder überlasten; Scan-Limits, Sicherheits- oder Attestierungsmechanismen umgehen; den Dienst zurückentwickeln, scrapen oder automatisiert darauf zugreifen; rechtswidrige Inhalte hochladen; oder die App nutzen, um Rechte anderer zu verletzen.
5. Bewertungen sind keine Beratung
Alle angezeigten Werte sind unverbindliche Schätzungen, erzeugt aus Daten und KI. Sie sind keine professionelle Schätzung und dürfen nicht für Versicherungs-, Steuer-, Kauf-/Verkaufs- oder Rechtsentscheide herangezogen werden. PenSnap bietet keine Anlage- oder Finanzberatung. Du bist allein für deine Entscheidungen verantwortlich.
6. Geistiges Eigentum
Die App, ihre Inhalte und ihr Branding gehören uns oder unseren Lizenzgebern und sind gesetzlich geschützt. Wir gewähren dir eine beschränkte, nicht-exklusive, nicht übertragbare, widerrufbare Lizenz zur Nutzung der App für persönliche, nicht-kommerzielle Zwecke. Deine eigenen Scans, Fotos und Sammlungsdaten bleiben dein Eigentum.
7. Haftungsausschlüsse / Gewährleistung
Die App wird „wie besehen“ und „wie verfügbar“ bereitgestellt, ohne jegliche Gewährleistung, soweit gesetzlich zulässig, einschliesslich einer Gewähr dafür, dass Identifikationen oder Bewertungen zutreffen oder dass der Dienst ununterbrochen oder fehlerfrei ist.
8. Haftungsbeschränkung
Soweit gesetzlich zulässig, haftet PenSnap nicht für indirekte, beiläufige oder Folgeschäden oder für finanzielle oder andere Entscheidungen, die auf Basis angezeigter Identifikationen oder Bewertungen getroffen werden. Soweit eine Haftung nicht ausgeschlossen werden kann, ist sie auf den Betrag beschränkt, den du in den 12 Monaten vor dem Anspruch für die App bezahlt hast.
9. Beendigung
Du kannst die Nutzung der App jederzeit beenden und dein Konto löschen (Profil → Konto löschen). Wir können den Zugang sperren oder beenden, wenn du diese Bedingungen verletzt oder um den Dienst zu schützen.
10. Anwendbares Recht
Diese Bedingungen unterliegen dem Recht der Schweiz, unter Ausschluss der Kollisionsnormen, und die Gerichte des Kantons Aargau, Schweiz sind ausschliesslich zuständig, sofern nicht zwingendes Konsumentenschutzrecht in deinem Wohnsitzland etwas anderes vorsieht.
11. Apple App Store
Diese Bedingungen bestehen zwischen dir und uns, nicht mit Apple. Apple ist nicht für die App oder ihre Inhalte verantwortlich. Apple und seine Tochtergesellschaften sind Drittbegünstigte dieser Bedingungen und können sie durchsetzen. Wartung, Support und allfällige Produktansprüche liegen in unserer Verantwortung, nicht bei Apple, ausser soweit dies nach Apples Standard-Lizenzvereinbarung für Endnutzer (Licensed Application End User License Agreement) erforderlich ist, die ebenfalls gilt und bei Widersprüchen zu Apple-spezifischen Punkten vorgeht.
12. Änderungen
Wir können diese Bedingungen aktualisieren. Wesentliche Änderungen werden durch Aktualisierung des Datums „Zuletzt aktualisiert“ und, wo angebracht, durch einen Hinweis in der App kenntlich gemacht. Die fortgesetzte Nutzung nach Änderungen gilt als Zustimmung.
